US L1 visa border refusal increase for Canadians under Trump

NAFTA the North American Free Trade Agreement came into force about twenty-five years ago. This brought many benefits for trade between the US, Canada and Mexico. One benefit is that for Canadians L1 intra-company transfer visas are easier to obtain than for many others. However, it seems that this may be changing under Trump.
The number of Canadians refused US L1 visas is rising, according to recent reports. Canadian citizens, applying as individuals or as part of L1 visa blanket petitions, face being refused entry to the US. Speculation is mounting that a possible new policy has been introduced or that entry refusal is only occurring at certain ports of entry.
Tier 2 Sponsor Licence and Brexit UK Visa Update
There is still the possibility of a “No Deal” Brexit which, if it happens, will mean that new EU citizen arrivals will need a Tier 2 visa or some other visa under the UK visa system. The Tier 2 Sponsor Licence, required by employers under the visa scheme, and Tier 2 visa system remains a difficult, expensive and bureaucratic system to navigate. It will probably be a long time before major changes are made to the UK visa system.
It has been suggested that both sides misled the electorate during the EU referendum about future UK visa policy. For example, the Leave Campaign suggested that there would be benefits for restaurant owners wishing to bring in chefs into the UK. So far this has not happened. In reality it seems that the restrictive UK visa system will continue.
US L1 Visa Update April 2019
L1 visas are in many cases the only work visa option to transfer staff to the US. For many companies obtaining each L1 visa is a huge effort. Indian and Chinese nationals cannot apply for an E2 visa. Therefore the L1 visa or H1B visa may be the only option in many cases.

National Foundation for American Policy (NFAP) has reported in the past that there are high refusal rates for the L1 visa in FY 2018. Compared with FY 2016, the refusal rate for L1B visa petitions in FY 2018 increased by 24%.
UK Visa Latest Brexit Update April 2019
The Brexit drama continues. The good news is that EU citizens can definitely stay in the UK on a long term or permanent basis. EU, EEA and Swiss citizens can apply for settled status if they have lived in the UK for five years or pre-settled status if they have lived in the UK for a shorter period. If you are in this situation, probably best to apply for this soon. It also seems that the Tier 2 Sponsor Licence and Tier 2 visa scheme will continue for a long time to come.

The EU has agreed an extension until 31 October 2019 for Brexit. If in the meantime the UK Parliament and the EU can agree terms for Brexit, Britain could leave earlier. EU, EEA and Swiss Citizens who do not currently live in the UK and wish to do so long term, should consider coming to the UK soon so that they can gain residence status in the UK. There continues to be uncertainty about exactly when free movement will end.
