UK immigration health surcharge to double on 8 January 2019
The UK Immigration Health Surcharge, which had been expected to double in December 2018, will increase on 8 January 2019 the Home Office has confirmed. The immigration health surcharge will increase from £200 to £400 per year for many UK visa categories including the Tier 2 visa, Tier 1 entrepreneur visa, Sole Representative visa and Tier 1 Investor visa categories. The UK visa fee for international students applying for the Tier 4 visa, those applying for the Tier 5 Youth Mobility Visa Scheme and for other Tier 5 visa applications will rise from £150 to £300 per year.
It seems that most migrants from outside the EEA will need to pay the increased immigration health surcharge. The UK must have amongst the highest (if not the highest) UK visa related fees in the World. For a large company to bring in a migrant on a Tier 2 visa with a partner and two children will be even more expensive now. Probably about £20,000.
US L1A visa requirements clarified claims USCIS
A policy memorandum issued by United States Citizenship and Immigration Services (USCIS) in mid-November 2018, was supposed to clarify L1A intra-company transfer visa rules. However, it appears that the memorandum – dated November 15, 2018 – has failed to clarify certain L1 visa regulations.
The US visa system is probably the most complex in the World. The US L1 visa requires more documentary evidence (unless you are a very large company and meet the requirements for blanket filing) than probably any other intra-company transfer visa anywhere in the World. In addition, even if you provide huge quantities of documentation it is still quite likely that you will be sent a Request for Further Evidence (RFE) and be asked for even more documentation.
UK visa white paper reveals new skills-based visa system
A heavily delayed UK immigrationWhite Paper was finally published by the government on 19 December, 2018 despite divisions within the Cabinet. The White Paper outlines Britain’s post-Brexit immigration policy, including foreigner worker rules, but Cabinet members were still squabbling over the White Paper just 24 hours before it was published.
Even if the Tier 2 Sponsor Licence and Tier 2 visa system is replaced it looks as if there will be many similarities to the current system. It is to be hoped that the new UK visa system will not be as bureaucratic and difficult to understand as the current UK visa system. UK visa related fees are also very high.
UK Tier 2 Visa Certificate of Sponsorship for January 2019
Following the latest Tier 2 visa allocation of restricted certificates of sponsorship meeting, the number of Certificates of Sponsorship (CoS) available for January 2019 stands at 2,119, according to UK Visas and Immigration data. The department published its December report, citing that its figures were correct as of 19 December, 2018.
Continuing good news for Tier 2 Sponsor employers wishing to employ those resident outside the UK on a Tier 2 visa. There is good availability under the quota. In most cases as long as the other requirements are met it should be possible to obtain a Tier 2 visa. There is continuing uncertainty relating to Brexit.
