For seven or eight months it was difficult for many people who needed to apply for a Tier 2 visa from abroad. June 2018 saw the highest salary requirement ever to obtain a tier 2 visa with in many cases a salary rate of £60,000 being required (unless you come under one of the exemptions). August 2018 saw the points requirement go down to 21 points. Therefore, in most cases the salary requirement will no longer prevent people meeting the Tier 2 CoS points requirement.
In many cases Tier 2 restricted Certificates of Sponsorship are being refused due to issues with the Resident Labour Market Test. Common problems include the following:
Not taking a screenshot of the advert during the time that it is online. It is recommended that you print to a pdf file on the first day of the advert.
Not paying the correct salary. The salary rate is based on a certain number of hours per week. If this is exceeded which means that the hourly rate is lower than the required level the Tier 2 restricted CoS will be refused.
Not putting an occupation code that is at the required level. In most cases the occupation code needs to be at least at RQF Level 6.
Making some sort of mistake on the online form. What may seem like minor mistakes may lead to refusal.
US L1 visa pilot strips Canadians of border processing
An L1 visa pilot scheme, targeting Canadian executives transferring to the US for their companies, is stripping them of a ‘perk’ they have enjoyed for years under the North American Free Trade Agreement (NAFTA). In the tiny US border town of Blaine, Washington DC, Canadian executives are no longer able to have their L1 visa processed on-the-spot.
NAFTA has greatly benefitted both the US and Canadian economies. It has made it much easier for Canadian professionals to live and work in the US, and also for US citizens and Mexicans to work in Canada. Obtaining an L1 visa for other nationalities is a difficult and complex process. Similarly the TN visa is much easier to obtain than say the H1B visa that is available for other nationalities. The process under NAFTA is much quicker, cheaper and easier. It is to be hoped that under Trump this does not change.
Tier 1 investor visa surge in number of immigrant applicants
Likely changes to the US$1 million US EB-5 immigrant investor visa are making the UK a more attractive investment opportunity for the super-rich. Tier 1 investor visa applications made by millionaire and billionaire immigrants soared by 46 per cent in 2017. The news comes amid a Home Office crackdown on the £2 million Tier 1 investor visa route.
UK Visas are in a difficult situation. Making it so difficult to apply for Tier 1 Investor visas may put off wealthy foreign investors so damaging the UK economy. On the other hand the UK Government does not want to be accused of allowing entry of people who may have gained their fortune via illegal means overseas.
Another issue is whether the Tier 1 Investor visa is actually always the best visa to apply for the “super rich”? Perhaps in some cases look at the Tier 1 Exceptional Talent visa, Tier 1 Entrepreneur visa and Tier 2 visa for employment with an employer with a Tier 2 Sponsor Licence.
US E2 and E1 visa access for New Zealand nationals happening
The Knowledgeable Innovators and Worthy Investors Act (KIWI Act), which will give New Zealanders access to US E1 treaty trader and E2 treaty investor visas, has been welcomed by New Zealand’s acting Prime Minister and Minister of Foreign Affairs. As recently reported by workpermit.com, the KIWI Act passed the US Senate on June 28, unanimously.
New Zealand nationals will eventually be able to gain entry to the US under the E2 and E1 visa scheme. This will greatly help New Zealand nationals work in the US and New Zealand businesses that wish to set up in the US. Other options to live and work in the US on non-immigrant US visas are somewhat limited. The L1 visa application requires a great deal of documentation for each application. The number of H1B visas are severely limited due to the quota system. However, with bureaucratic delays how long will it be in reality before New Zealanders will be able to apply under the E2 visa and E1 visa scheme.
