One bit of good news that will benefit a number of migrants is the reduction in the salary requirements to obtain a tier 2 restricted certificate of sponsorship since 6 July 2018. Many more people based abroad will now qualify for a tier 2 visa.
UK tier 2 visa for foreign NHS workers was backed by Jeremy Hunt
For seven months until June 2018, due to the salary requirements, many restricted CoS applications to bring in tier 2 visa skilled overseas workers based outside the UK had been refused.
The changes that have occurred recently to the tier 2 visa scheme had the backing of a number of Government ministers. It seems that Theresa May the Prime Minister had previously blocked plans for a relaxation of tier 2 visa requirements for health care workers. Eventually, with all the bad publicity over shortages of doctors and nurses in UK hospitals the Government changed the law from 6 July 2018.
Thanks to doctors and nurses no longer coming under the quota, in July 2018 the salary requirement to gain enough points for a restricted CoS has gone down considerably. As the backlog of applications start to clear, we think that in August 2018 it will go down further. There is a good chance that the current system will continue for some time and the availability of restricted certifications of sponsorship should continue to improve.
US startup visa just 10 applications under Donald Trump; try E2 and L1
Introduced two years ago by former President, Barack Obama, in the closing months of his time in office, the US startup visa scheme was touted as a program that would ‘attract thousands of foreign entrepreneurs, boosting jobs and the US economy. Instead, the program has received just 10 applications, plunging its future into doubt.
In the US there are already a number of options for businesses wishing to start up in the US with a relatively small investment. There is the E2 treaty investor visa scheme and E1 treaty trader visa (not available to Indians and Chinese). There is also the L1 intra-company transfer visa. This new US visa option would have been a welcome addition. However, with so much hostility by Trump towards this scheme it stood little chance of success.
UK Tier 1 Investor visa checks target Indian millionaires
On 6 May, 2018 workpermit.com reported that the UK Tier 1 Investor visa had been targeted for a crackdown by Prime Minister, Theresa May. Following the nerve-agent poisoning of a former Russian spy Sergei Skripal and his daughter Yulia on UK soil, the Home Office launched an investigation into Tier 1 Investor visas issued to wealthy Russians.
Tier 1 Investors have invested large sums of money into the UK. It is to be hoped that any investigation into investment money is fair and reasonable and not part of the “aggressive” Home Office policy we have seen in the past. Investors have brought enormous economic benefit to the UK.
US E2 visa eligibility for Ecuador affected by end of investment treaty
A notice issued by the US government on May 18, 2018, terminating Ecuador’s bilateral investment treaty with the United States, will affect E2 visa eligibility for Ecuadorean nationals. The Office of Trade Representative for the US Department of State officially announced the end of the treaty in the Federal Register.
It can be very difficult to obtain work visas for the US. Companies and businessmen from Ecuador will no longer be able to apply for E2 treaty investor registration. Since 18 May 2018 only those organisations that already E2 registered will be able to apply for E2 visas. The alternatives to the E2 visa are difficult to obtain. Employers in some limited circumstances can apply for the L1 visa and H1B visa. There is also the B1 in lieu of H1B visa.
