Immigration has always been a challenging and complex issue, and the UK is no exception. The Government's action against corrupt immigration lawyers is making headlines. This initiative is perhaps somewhat hypocritical. What about corruption among Government lawyers and Government officials? Can we have the following undertakings from the Government:
  • Government Legal Services lawyers and lawyers acting for the Government to stop falsifying evidence, and falsifying witness statements.
  • Home Office officials to stop making false statements and falsifying evidence.

There seems to be no action taken against those people who work in a Government Agency or are given powers by the Government who commit very serious criminal offences.

UK Government Taskforce

The UK government has launched a dedicated taskforce aimed at lawyers who allegedly coach illegal migrants to lie, thereby manipulating the immigration system. This taskforce, known as the Professional Enablers Taskforce, comprises regulatory bodies, law enforcement teams, and government departments.

Apparently, some immigration lawyers assist illegal migrants in making false claims to prolong their stay in the UK. This taskforce is designed to increase enforcement action against such lawyers. Can we also have a taskforce to look at criminal offences committed by Government lawyers, regulators, and officials?

The Taskforce's Approach

The Professional Enablers Taskforce has been operational for a few months, carrying out preliminary work in collaboration with its partners. The taskforce aims to curb immigration abuse in the legal sector by enhancing the sharing of intelligence and information among regulators. The official launch of the taskforce may help with rooting out immigration fraud amongst immigration lawyers.

The taskforce has developed a new training program for frontline staff working in the immigration system. This program will equip them with the skills to identify and report suspicious activity, thereby aiding law enforcement in prosecuting corrupt immigration lawyers. It seems nothing will be done about corrupt officials and corrupt lawyers acting for the Government.

Impact on the Legal Sector

Working in tandem with industry bodies, the taskforce intends to disrupt the business models of firms that facilitate immigration system abuse. The objective is to support enforcement action against corrupt lawyers by bolstering evidence and improving intelligence sharing. This intelligence is then passed on to industry bodies for investigation and, if necessary, referred to law enforcement for prosecution.

The taskforce has already made referrals to law enforcement where criminal activity is suspected. For instance, it has unearthed a case where an immigration firm is reportedly linked to a notorious human trafficker. This case has been referred to the police for further action.

Role of Regulatory Bodies

Regulatory bodies like the Solicitors Regulation Authority (SRA), which acts as a legal industry watchdog, are part of this initiative. The SRA has recently suspended three legal firms accused of offering to submit fake asylum claims for migrants.

Comments from Government Ministers

Home Secretary Suella Braverman commented on this issue, emphasizing the need to bring corrupt immigration lawyers to justice. She stated that while most lawyers act with integrity, a few are allegedly assisting illegal migrants to exploit the system, which she says is neither right nor fair to those who abide by the rules.

Lord Chancellor and Secretary of State for Justice Alex Chalk KC also expressed his views. He stressed that the integrity of the UK's legal system hinges on the accuracy and honesty of legal advice. He feels those who encourage deception must be held accountable.

Legal Implications

Lawyers found guilty of coaching migrants on how to fraudulently remain in the country could be prosecuted under the Immigration Act 1971, Section 25, for 'Assisting unlawful immigration to the UK'. They could potentially face a life sentence. However, it seems that no action will be taken against Government lawyers, Government officials, and regulators committing the offence of perverting the course of justice, who on conviction, would usually face a prison sentence.

Expansion of the Taskforce

While the Professional Enablers Taskforce is currently focusing on the legal sector, there are plans to expand its reach to other 'professional enablers'. These include doctors, accountants, and employers who may use their expertise to facilitate illegal migration.

Allegations of Dishonesty by Government Officials

While the government's initiative may be necessary, it has also sparked debate. Some argue that the government's attempts at prosecuting immigration lawyers are hypocritical. Allegations have been made against government agencies of perverting the course of justice and creating an environment where corruption in the legal system is accepted. There is a call for similar prosecution of government officials and lawyers who may be guilty of such offences.

Corruption in the British Legal System

The Government's main focus seems to be to target corrupt immigration lawyers.  Last week, the independent Legal Services Board announced it was consulting on enhancing the Solicitors Regulation Authority's fining powers. The board is exploring other ways to boost regulators' powers to ensure rogue legal professionals are penalized. However, what happens when some of the people working at the regulator themselves turn out to the corrupt and dishonest?

Is the clampdown on corrupt immigration lawyers politically motivated? It's essential to address the broader issue of corruption in the legal system. Ensuring the integrity of the legal system is critical to maintaining public trust and ensuring justice is served. This means that the Government needs to also prosecute Government lawyers, Government officials, regulators, etc where there is evidence of criminal conduct.
